This Affiliate Agreement is a binding agreement between Netz Inc., a Florida corporation doing business as Netz0, and you, the person or entity approved to participate in the Netz0 Affiliate Program. It supplements the Netz0 Terms of Service, which continue to apply to your Netz0 account; where this Agreement conflicts with the Terms for affiliate matters, this Agreement prevails.
The short version: you apply, we approve, you refer customers through your affiliate links, and you earn the commission rates shown in your affiliate dashboard on qualifying sales. Commissions become payable once valid (the customer paid and stayed), and fraud of any kind ends the relationship. Separate from this program, every customer has a simple referral link — that feature is governed by its own terms in your account, not this Agreement.
1. Joining the Program
1.1 Participation requires an application and Netz0's approval, at Netz0's sole discretion. Netz0 may decline or revoke participation without obligation to state a reason.
1.2 You must have a Netz0 account in good standing and be of legal age to contract. Netz0 employees and their household members are not eligible.
2. Commissions
2.1 Commission rates, qualifying products, and program terms are displayed in your affiliate dashboard and may be individually configured for your account. Rates apply to qualifying purchases made by customers who signed up through your affiliate link, as tracked by Netz0's systems, which are the authoritative record of attribution.
2.2 A commission becomes valid when the referred purchase has been fully paid, has passed the applicable money-back-guarantee window, and is not refunded, reversed, disputed, or found fraudulent. No commission is due on: refunded or charged-back purchases; purchases by the affiliate's own accounts or on their behalf (self-referrals); purchases that violate the Terms of Service or AUP; or account credit top-ups.
2.3 Netz0 may adjust or reverse commissions where the underlying transaction is reversed or found invalid, including after payout, by offsetting future commissions.
3. Settlement and Payout
3.1 Commissions are settled monthly. Settlement statements are available in your affiliate dashboard; you have seven (7) days from the statement date to dispute a settlement, after which it is final.
3.2 Valid commissions are paid once your balance reaches the minimum payout threshold shown in your dashboard, via the payout method selected in your account. Amounts below the threshold roll forward. You are responsible for any taxes on your commission income, and Netz0 may require tax documentation (such as a W-9 or W-8) before payout.
3.3 If your participation ends, valid commissions above the minimum threshold at the time of termination are paid in the normal cycle; pending commissions that never become valid are forfeited. Commissions are forfeited entirely where termination is for fraud or breach of this Agreement.
4. Promotion Rules
4.1 You may promote Netz0 honestly, in your own name and voice. You may not:
- misrepresent yourself as Netz0, as Netz0's agent, or as authorized to make commitments on Netz0's behalf;
- make false or misleading claims about Netz0's services, pricing, or guarantees;
- use spam, unsolicited messaging, or any promotion that violates the Netz0 AUP or applicable law;
- use incentivized traffic, forced clicks, cookie stuffing, self-referrals, or any artificial means of generating referrals;
- bid on Netz0's brand names or confusingly similar terms in paid search, or register domains containing Netz0 marks;
- promote on sites containing unlawful content.
4.2 Use of Netz0's names, logos, and marketing materials is licensed only as provided through the affiliate dashboard or with prior written consent, is revocable, and ends with your participation.
4.3 Where required by law (including FTC endorsement guidelines), you must disclose your material connection to Netz0 — that you earn commissions on referrals.
5. Fraud
Fraudulent activity of any kind — fabricated referrals, payment fraud, manipulation of tracking, or breach of the promotion rules — results in immediate termination of participation, forfeiture of all commissions, and, where applicable, enforcement under the Terms of Service and applicable law.
6. Term, Termination, and General
6.1 Either party may terminate participation at any time. Netz0 may suspend participation during investigation of suspected fraud or breach.
6.2 The parties are independent contractors; nothing here creates employment, agency, partnership, or joint venture.
6.3 Netz0's total liability under this Agreement is capped at the commissions paid or payable to you in the twelve (12) months preceding the claim. The Terms of Service's disclaimers, indemnity, governing law, and dispute provisions (Florida law; Miami-Dade County courts) apply to this Agreement.
6.4 Netz0 may update this Agreement and the program terms; material adverse changes will be notified per the Terms of Service before taking effect. Continued participation after the effective date constitutes acceptance.
7. Customer Referral Links
Separately from this Affiliate Program, Netz0 customers may have access to a personal referral link with rewards described in the customer's account. That feature does not require an affiliate application; it is governed by the terms shown alongside it in the account and by the Terms of Service, not by this Agreement.
